2. The petitioner seeks regular bail in connection with Parsauni P.S. Case No.95 of 2024 lodged dated 21.06.2024 under Sections 341, 323, 324, 307, 504/34 of the I.P.C. Later on added section 302 of the I.P.C.
3. As per the prosecution case, the F.I.R. has been lodged against three named accused persons including the petitioner against whom there is allegation that the dispute was going on between the nephew of the informant with one Divyanshu Kumar and informant was also there to settle the matter, but in the meantime, three accused persons including the petitioner had reached there and started assaulting the
Patna High Court CR. MISC. No.71858 of 2024(2) dt.03-10-2024 2/3 informant. The allegation of assault is upon other accused persons and the allegation against the petitioner that he has thrown the father of the informant due to which he became unconscious and admitted to the hospital.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that both informant and accused persons are resident of same village and they are well-known to each other. The scuffling took place on local petty issue.
5. Learned Counsel further submits that the dispute has arisen between the children of their family, but when scuffling took place then without any bad intention, this unfortunate event took place.
6. Learned Counsel further submits that the petitioner is in custody since 23.06.2024 having clean antecedent.
7. Learned counsel for the State opposes the prayer for bail and submits that the specific allegation is against the petitioner.
8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount
