The petitioner has been in custody since 19.10.2017 in connection with Nasriganj P.S. Case No. 208/2017 registered for the offences punishable under Sections 364 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report, but subsequently, on the basis of confessional statement made before the police by a co-accused, the petitioner's name has been drawn in connection with the present case. It is further submitted that the victim has now been recovered and the statement has been recorded under Section 164 Cr. P.C. wherein the petitioner has not been named.
