The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The prosecution case in nutshell is that unknown seven miscreants arrived at the house of informant, thereafter they tied the informant and his family members with ropes and looted jewelry, cash Rs. 20-25 lakhs, licensed revolver, cartridges etc. and fled

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R. nor he has been put on T.I.P. Nothing incriminating has been recovered from his possession. The name of petitioner sprang up in this case on confessional statement of co-accused Ankesh Kumar @ Maikal. Moreover, the petitioner is languishing in judicial custody since 06.07.2022. Similarly situated co-accused persons have been granted bail by coordinate Bench of this Court. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on
