The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 30(a), 36, 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 2027.52 liters of foreign liquor is said to have been recovered from the different vehicle. He submits that the petitioner has no concern with the alleged vehicle or seized foreign liquor. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.

Patna High Court CR. MISC. No.69039 of 2022(2) dt.12-01-2023 2/2 However, learned APP for the State opposes the prayer for bail and submits that huge quantity of liquor has been recovered from the place of occurrence and petitioner is also involved in this case.

Considering the facts and circumstance of the case and the fact that huge quantity of liquor has been recovered from the place of occurrence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Baligaon P.S. Case No. 80 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
