2. The petitioner seeks bail in connection with Simiri P.S. Case No. 146 of 2025 registered for the offence punishable under Sections 140(3) and 3(5) of the Bharatiya Nyaya Sanhita.

3. The petitioner was caught red-handed with the kidnapped victim child aged about one year.

4. The petitioner is in custody since 12.05.2025.

5. It has been submitted by learned counsel for the petitioner that the co-accused Reena Devi, who was involved in kidnapping the one year old boy from his house has been granted bail. It has come during investigation that Reena Devi had handed over the child to the petitioner who had taken away and thereafter on police pressure, when he was coming back, he

6. Considering the fact that the child was recovered from the petitioner, I am not inclined to grant bail to the petitioner.

7. Accordingly, the application stands dismissed.

8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial.
