JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2019 This is an application for grant of anticipatory bail in connection with Bihar P.S. Case no. 303 of 2019, disclosing offences under Sections 341, 323, 325, 504, 506, 307, 379, 295(A) and 34 of the Indian Penal Code.

As per F.I.R., the prosecution case is that several accused persons including the petitioners entered the house of the informant and assaulted him and also looted ornament articles and snatched Rs. 12000/- from his pocket. Submission of learned counsel for the petitioner is that no specific allegation is attributed against the petitioners, as a matter of fact petitioners were offering prayer and the informant and other started playing D.J. in loud voice as such

Patna High Court CR. MISC. No.63511 of 2019(3) dt.03-12-2019 2/2 some altercation was held between the parties. Taking advantage of this the petitioners have falsely been implicated in this case and there is no specific allegation against them and they have no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below withing six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M. Nalanda at Bihar Sharif, in connection with Bihar P.S. Case No. 303 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
