Petitioner seeks bail in a case registered for the offences punishable under Sections 399,402 of the Indian Penal Code, Section 25(1-b)a, 26,35 of the Arms Act and Section 20,22 of N.D.P.S.Act.
Submission is that case of the petitioner is on better footing to that of co-accused-Ajay Patel and others, who have been allowed bail by a Coordinate Bench of this Court vide Annexure-2 series. The petitioner is in custody since 30.08.2015. Allegation is that only two cartridges were recovered from possession of the petitioner.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing
Patna High Court Cr.Misc. No.29039 of 2018 (2) dt.14-05-2018 bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.07 of 2017 arising out of Yogapatti Police Station Case No.279 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
