2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that 360 liters of country made Nepali liquor was recovered from a Scorpio.

4. Learned counsel for the petitioner has submitted that as per the FIR, the petitioner is the driver of the Scorpio. It has further been submitted by the learned counsel for the petitioner that the petitioner was having no knowledge regarding the illicit liquor. The petitioner is only the driver of the Scorpio

Patna High Court CR. MISC. No.68678 of 2025(2) dt.24-09-2025 2/2 and is a man of clean antecedent. Learned counsel has also submitted that the petitioner is languishing in judicial custody since 01.07.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bathanaha P.S. Case No. 320 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court -1, Sitamarhi.
