The present revision application has been preferred to release the petitioner on bail on the ground of juvenile in connection with Kajra P.S. Case No.45 of 2016 registered under Sections 147, 148, 149, 353, 307 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act, pending in the court of J.J.B., Lakhisarai as G.R. 1543/2016. The J.J.B., Lakhisarai has refused to release the petitioner on bail vide order dated 22.05.2019 although Board has accepted that the petitioner a juvenile on the date of occurrence and further Additional District and Sessions Judge-1-cum-Children Court, Lakhisarai has also refused to release on bail vide Cr. Appeal

learned counsel for the petitioner submits that the Juvenile Justice Board, Lakhisarai has refused to release the petitioner on bail though there is a clear cut finding that the petitioner is a juvenile and as per provision of Section 12 of the J.J.B. Act, he is entitled to the privilege of bail as from very perusal of the order dated 22.05.2019, it appears that the petitioner, who is a juvenile, needs care and protection. He thus submits that the petitioner may be released on bail. Considering the aforementioned facts and circumstances, let the above named petitioner, a juvenile, be released, on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Juvenile Justice Board, Lakhisarai, in connection with Kajra P.S. Case No.45 of 2016, G.R. 1543/2016, in favour of his father, who shall keep him under his guardianship and produce him as and when required. (Anjana Mishra, J) amit/- U T
