This appeal has been filed for setting aside order dated 02.09.2024 passed in a case registered for the offence punishable under sections 341, 323, 353 , 333 , 324, 504, 506 and 34 of the Indian Penal Code and sections 3(i)(r)(s), 3(2)(v) (a) of the Scheduled Castes and Scheduled Tribes, whereby the prayer for anticipatory bail of the appellant has been rejected. 3 . The prosecution case in brief, is that informant who is Choukidar of Police station who was simply discharging his duty and on 01.04.2024 , while informant was returning, in the meantime , all the accused persons named in the F.I.R., including these appellants assaulted and abused him by caste
Patna High Court CR. APP (SJ) No.4519 of 2024(4) dt.01-05-2025 2/2 name and pressed his neck and assaulted him by fists and slaps on his mouth as a result of which his right eye was injured. It is further alleged that accused persons also snatched his gold chakti and threatened him with dire consequence.
4. Considering the fact that all the accused persons including these appellants assaulted informant who is Choukidar of the concerned Police station and created obstruction in discharge of his duty and other circumstances of case, and I do not find any reason to interfere with the impugned order, accordingly this appeal is dismissed.
