2. The petitioner apprehends arrest in connection with Gogri P.S. Case No. 180 of 2022 dated 05.07.2022, instituted for the offence punishable under Section 366 (A) of the Indian Penal Code.
3. The prosecution case, in short, is that on 05.07.2022 at about 04:00 am accused Pintu Yadav abducted minor daughter of the informant aged about 17 years. The informant went to the house of Pintu Yadav and told his family members that accused person can kill his daughter.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that victim girl was recovered and her statement under Section 164 Cr.P.C. was recorded in which she stated that on 05.07.2022 she went out from her house on her
Patna High Court CR. MISC. No.72128 of 2023(3) dt.29-02-2024 2/2 own sweet will and called Pintu Yadav by mobile. Both went to Chandigarh and they got married at Katihar while on way to Chandigarh. It is further submitted that victim filed an application in the court of learned C.J.M., Begusarai that she is aged about 20 years and she is able to take care of her own security and can lead her life own her sweet will. Considering the facts, learned C.J.M. released her upon her responsibility vide order dated 03.08.2023. Lastly, it has been submitted that he has no criminal antecedent.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner in connection with Gogri P.S. Case No. 180 of 2022, he shall be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Khatim Reza, J) prabhat/- U T
