JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Sri Mukesh Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody in connection with Industrial Area P.S. Case No. 44 of 2018, registered for the offence under Sections 414/ 34 of the Indian Penal Code, 1860 and Section 30 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail purely on parity. Learned counsel for the petitioner submits that in similar circumstances two accused namely Pankaj Kumar Das and Aditya Raj @ Chhotu have already been granted bail by this court vide Cr. Misc. No. 27781 of 2018 on the ground that huge quantity of Indian make foreign liquor was shown to be recovered from tractor garage of one Raj Kumar Das.

Patna High Court Cr.Misc. No.27902 of 2018(2) dt.08-05-2018 2/2 Considering the fact that in similar circumstances other two persons have been granted bail, there is no reason to refuse the same relief to the petitioner .

Let petitioner namely Ritesh Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II - cum - Special Judge ( Excise Act ) , Vaishali at Hajipur / concerned court in connection with Industrial Area P.S. Case No. 44 of 2018.
