2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that from a bike which was driven by the petitioner, namely, Sunil Kumar of Cr. Misc. No. 68142 of 2025 altogether 60 liters of country made

Patna High Court CR. MISC. No.68142 of 2025(2) dt.24-09-2025 2/3 liquor whereas from the bike which was driven by petitioner, namely, Rajdev Ray of Cr. Misc. No. 68213 of 2025 altogether 120 liters country made liquor was recovered.

4. Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioners. Moreover, the petitioner is languishing in judicial custody since 23.08.2025 and 19.08.2025 respectively.

5. Learned APP appearing for the state has opposed the prayer of regular bail that the petitioner of Cr. Misc. No. 68213 of 2025 has three criminal antecedent.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Nawada Excise P.S. Case No. 601 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Nawada.
