====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 10-12-2025 Heard Mr. Ganesh Sharma, learned counsel for the petitioner and Mr. Anish Chandra, learned APP for the State.
2. Petitioner seeks regular bail in connection with Ekangarsarai P.S. Case No. 71 of 2025 dated 09.04.2025 registered for the offences punishable under sections 137(2), 351 & 352 of the Bharatiya Nyaya Sanhita and later on, sections 4 & 6 of the POCSO Act were added.
3. The main submissions advanced by petitioner's counsel are that the petitioner is a 19 year old person and has no criminal antecedent and the informant's daughter, who is said to be the victim, has recorded her statement before the Judicial Magistrate, in which she did not reveal any allegation against the petitioner and stated that she had gone with the petitioner on her own will only for sightseeing and except this, nothing was
Patna High Court CR. MISC. No.67486 of 2025(3) dt.10-12-2025 2/2 revealed by the victim showing the commission of the alleged offences under which the FIR has been registered. It is lastly submitted that the petitioner has been languishing in jail since 01.06.2025 and against him the investigation has been completed.
4. No one appears on behalf of the O.P. No. 2.
5. Though learned APP for the State has opposed the prayer of the petitioner but fairly accepts that the victim did not make any allegation against the petitioner in her statement recorded before the Judicial Magistrate.

Considering the aforesaid submissions and mainly the petitioner's custody period, his fair and clean antecedent and completion of investigation against him, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Ekangarsarai P.S. Case No. 71 of 2025.
