Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code in connection with Nokha P.S. Case No. 56/2018.
Allegation against the petitioner is of giving wrong information that forging his signature, the Mukhiya has withdrawn the amount and the said amount has not been distributed amongst the members of Wards. It is also alleged that without preparing the estimate and getting the approval of the informant, the account of
Patna High Court Cr.Misc. No.28224 of 2018 (2) dt.17-05-2018 2/2 the ward members were opened and confirmed that the amount was transferred.
Submission of the learned counsel for the petitioner is that earlier he had also lodged a case. Further submission is that signature was not verified.
Heard learned Additional Public Prosecutor also. Having heard both sides, in view of the aforesaid facts, the present petition is disposed of with a direction that the petitioner will surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order and will be released on provisional bail till submission of the charge-sheet on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Nokha P.S. Case No. 56/2018, subject to the condition that after investigation if the case is found true and charge-sheet has been submitted against the petitioner, he will surrender and pray for regular bail.
