The petitioner seeks bail in connection with Patarghat P.S. Case No. 97 of 2024 instituted for the offence under Sections 120(B), 302/34 of the Indian Penal Code. 3.

Prosecution case in short is that that the brother of the informant was done to death by the accused persons including the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 31-05-2024. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present

From perusal of the FIR itself, it appears that daughter of the petitioner was alleged to be in love affair with the brother of the informant (deceased). Petitioner is female. There is no eye witness to the occurrence. There is no specific allegation against the petitioner rather allegation is general and omnibus that too on the basis of mere suspicion. It is lastly submitted that police after investigation has already submitted charge sheet in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP submits that cause of death is opined to be hemorrhagic shock by blunt substance. It is fervently submitted that petitioner in his confessional statement has confessed her guilt, which fact finds mention at paragraph No. 23 of the case diary. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Patarghat
