JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-04-2022 Heard Mr. Tara Nath Jha, learned counsel for the petitioner and Mr. Umesh Narain Dubey, learned A.C. to G.P. -27 for the State. No one appears for the Veer Kuer Singh University, Ara.
The case of the petitioner in nutshell is that the petitioner retired from the post of Demonstrator ( teaching) from Shershah College, Sasaram in June, 2007 and his pension was fixed at Rs. 11770/- in the pay scale of 6th Pay Revision starting from August 2012.
Learned counsel for the petitioner submits that without giving any notice and / or show cause pension of the petitioner has been reduced by letter dated 12-04-2018 kept at
Patna High Court CWJC No.17061 of 2017(22) dt.06-04-2022 2/2 Annexure -C to the supplementary counter affidavit filed on behalf of the respondent nos. 3, 4 & 5 and a sum of Rs. 3,85,129/- has been adjusted from the retiral dues of the petitioner.
In view of the nature of grievance of the petitioner, let a detailed representation be filed by the petitioner before the Vice Chancellor, Veer Kuer Singh University, Ara i.e. Respondent No. 4 within a period of six weeks from today raising his grievance and if such a representation is filed by the petitioner, the Respondent No. 4 / Vice Chancellor, Veer Kuer Singh University, Ara shall be obliged to dispose of the same in accordance with law by a reasoned order after giving an opportunity of hearing to the petitioner within a further period of three months from the date of filing of the representation. Needless to say that if any amount is found payable to the petitioner, the same shall be paid within a further period of one month from the date of disposal of the his representation. With the aforesaid observation and direction, the writ petition stands disposed of.
