2. The petitioner has preferred this application for grant of regular bail in connection with Sohsarai P.S. Case No. 178/2025 dated 27.06.2025 registered for the offences punishable u/s 352, 351(2) and 109 of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, 4 boys came to the hotel of the informant and demanded cigarette on which the informant told them that he has no cigarette then they threatened him and went away. Thereafter, they came back holding weapons and started threatening and abusing and with an intention to kill fired three rounds but the informant escaped.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The coaccused, Bhisma Yadav disclosed the name of the petitioner in the crime alleged. As per para. 16 of the case diary, the coaccused Bhisma Kumar was arrested along with the petitioner as they were sleeping in the same room and from the said room one country-made pistol and two live cartridges were recovered from the bed on which they were sleeping. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda at Biharsharif in connection with Sohsarai P.S. Case No. 178/2025 with the condition:-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
