The sole petitioner, who is in custody since 16.03.2018, has prayed for grant of bail in Rajiv Nagar P.S. Case No.68 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It was submitted by learned counsel for the petitioner that the petitioner was driving TATA Indigo Car of his owner without any knowledge as to whether in the dickey of the vehicle, any liquor was kept or not. The said vehicle was intercepted by the police and on search from the dickey of the vehicle, about 58 liters of country-made liquor was shown to be recovered and the petitioner, being driver of the vehicle, has

Learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. Learned Addl. Public Prosecutor has opposed the prayer for bail.

However, considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner, namely, Vikram Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No.2444 of 2018, arising out of Rajiv Nagar P.S. Case No.68 of 2018.
