The petitioner seeks regular bail in connection with Rohtas P.S. Case No. 296 of 2017, registered for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act. The prosecution case in brief is that the police got information that one Dudheshwar Prasad has been kidnapped and was being kept in the house of Shatrughan Paswan whereafter the police party had surrounded the house of said Shatrughan Paswan and two persons including the petitioner herein were apprehended from whom various articles, cash and two live cartridges were recovered.
The learned counsel for the petitioner submits that as far as the petitioner is concerned, only two live cartridges
Patna High Court Cr.Misc. No.28460 of 2018(2) dt.09-05-2018 2/2 have been recovered and in fact, no ransom money has been recovered from the possession of the petitioner herein. The petitioner is stated to be in custody since 17.10.2017 and he is having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Rohtas at Sasaram in connection with Rohtas P.S. Case No. 296 of 2017.
