Petitioners apprehend their arrest in Amarpur P.S. Case No.233 of 2019 registered under Sections 147, 341, 323, 353, 379 and 411 of the Indian Penal Code and under section 8 of the Bihar Mineral Prevention of Illegal Mining Transportation Storage Rule 2003 and under section 15 of the Forest Environment Act.

The police raided the place situated near the bank of Chanan river and found many tractors loaded with sand. It is alleged that the petitioners and others prevented the police from seizing the tractors loaded with sand.

Patna High Court CR. MISC. No.62639 of 2019(2) dt.17-10-2019 2/2 Learned counsel for the petitioners submits that the petitioners are ladies and they have falsely been implicated in the case. In fact, the tractor of the petitioners was parked at the door. The police came and tried to seize the tractor from the door of the petitioners.

Having considered the facts and the nature of allegation made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P.S. Case No.233 of 2019 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
