The petitioner apprehends his arrest in connection with Guraru P.S. Case No. 110 of 2022 for the offence registered under Sections 147, 148, 149, 323, 427, 337, 504 and 353 of the Indian Penal Code.
As per the prosecution story, the allegation is that the accused persons were protesting against the 'Agnipath' Scheme of the Government of India in which the procession became aggressive, blocked NH-69 and on arrival of the police also tried to assault them. Accordingly, the FIR was lodged. Learned counsel for the petitioner submits that he is a student, was an onlooker, had nothing to do with the agitation of the procession but has wrongly been implicated in this case. Patna High Court CR. MISC. No.68456 of 2022(2) dt.24-01-2023 2/2 has since been extended the benefit of anticipatory bail in Cr. Misc. No. 56421 of 2022 (Rahul Yadav @ Rahul Kumar). Let the same be kept on record.
Taking into account the kind of allegation, he do not have criminal antecedent, is a student appearing for competitive examination, this Court is inclined to extend him privilege of anticipatory bail.
Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Gaya in connection with Guraru P.S. Case No. 110 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
