The petitioner seeks anticipatory bail in connection with Sono P.S. Case No. 168 of 2016, G.R. No. 2049 of 2016 registered for offences punishable under Sections 323, 448, 452 and 376 of the Indian Penal Code.

Allegation against the petitioner is of committing rape with the informant.

Submission of the learned counsel for the petitioner is that police after investigation has not found the case true against the petitioner under Section 376 of the Indian Penal Code and submitted charge sheet and learned Magistrate has taken cognizance against him.

Learned A.P.P. as well as learned counsel for the

Patna High Court Cr.Misc. No.29225 of 2018 (3) dt.05-07-2018 2/2 informant oppose the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Sono P.S. Case No. 168 of 2016, G.R. No. 2049 of 2016, to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Jamui, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned and petitioner shall cooperate in the trial and shall be present before Court as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bonds.
