Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 307, 498(A)/34 of the Indian Penal Code and section 3⁄4 of D.P. Act. As per the prosecution case, petitioners and coaccused Md. Raj Ansari are alleged to have committed torture and harassment to the informant due to non-fulfillment of demand of dowry.

It is submitted that petitioner no.1 is mother-in-law,

Patna High Court CR. MISC. No.67994 of 2022(2) dt.04-04-2023 2/2 petitioner no. 2 nanad, petitioner no. 3 is father-in-law and petitioner no.4 is devar of informant. Thrust of accusation is against co-accused Md. Raj Ansari (husband of the informant), who is already in custody. Petitioners are separate in mess and property and have got no concern with the affairs of the couple. There is general and omnibus allegation against these petitioners and they have got clean antecedent.

Learned APP has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Brahampur P.S. Case No. 380 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
