JUSTICE ARUN KUMAR ORAL ORDER 11-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Srinagar P.S.Case No. 08 of 2018 registered under Sections 302, 323, 341, 342 and 504 of the Indian penal Code.

Allegation in brief is that due to land dispute, quarrel took place and on exhortation given by the petitioner, her husband Md. Mukhtar and Md. Rizwan assaulted the informant's brother-in-law on his neck and others assaulted with leg and fist as a result he died.

Submission is that cause of death, as per the postmortem report, is the injury caused to deceased and that related to Md. Rizwan. He further submits that petitioner is a lady and has no criminal antecedent.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.29551 of 2018(2) dt.11-05-2018 2/2 specially no specific allegation of assault attributed to the petitioner, so the petitioner, namely, Tetri Khatoon, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Srinagar P.S. Case No. 08 of 2018.
