JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-12-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Complaint Case No. 511 of 2017 registered under Sections 323, 354 and 379 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that the allegation of outraging the modesty of the

Patna High Court Cr.Misc. No.57865 of 2017 (2) dt.20-12-2017 2/2 complainant is confined against co-accused Chhotu Kumar and the petitioners have been named in the complaint only because they happen to be brothers of said Chhotu Kumar. He submitted that even otherwise, the case is based on a complaint, which was filed after more than five days of the alleged occurrence. Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioners. Regard being had to the facts and circumstances of the case and the submissions made on behalf of the petitioners, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in Complaint Case No. 511 of 2017, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today. (Ashwani Kumar Singh, J.) Kanchan/- U T
