2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 399, 402 & 120(B)/34 of the Indian Penal Code and under Sections 20(B) (ii)(c), 23(c) and 29 of the Narcotic Drugs and Psychotropic Substances (in short 'N.D.P.S.') Act.

3. The case of the prosecution in short is that three persons were apprehended and from their possession certain articles including arms and contraband was recovered. The name of this petitioner was disclosed by the apprehended persons.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.68127 of 2025(2) dt.24-09-2025 2/2 that nothing has been recovered from the possession of the petitioner and the name of the petitioner has surfaced only on the statement of the co-accused. Learned counsel has further submitted that the petitioner is languishing in judicial custody since 17.03.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with N.D.P.S. Case No. 69 of 2025 arising out of Town P.S. Case No. 306 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Court no. II, NDPS, East Champaran, Motihari.
