JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Mohiuddin Nagar P. S. Case No. 46 of 2017, disclosing offence under Section 394 of IPC.

As per prosecution case, there is allegation of snatching of Rs.1,30,000/-, mobile phone and other articles from the informant, who is businessman.

Submission of the learned counsel for the petitioner is that those mobile phone and other articles were recovered from the co-accused. He has been made accused only on confessional statement of the co-accused.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that in such type of cases, unless the petitioner surrender, the identification parade is not possible.

Patna High Court CR. MISC. No.70347 of 2019(2) dt.16-01-2020 2/2 Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
