Counsel for the petitioner and learned APP for the State. The learned Sr. Counsel for the petitioner has submitted that, though on earlier occasion, the anticipatory bail petition of the petitioner was rejected on 20.09.2022, but he has renewed his prayer for anticipatory bail on fresh ground that the condition of son of the petitioner is precarious due to down syndrome and his son is unable to perform his daily routine and

Patna High Court CR. MISC. No.74831 of 2022(2) dt.11-01-2023 2/2 it has become the duty of the petitioner to assist his son in his daily routine. He has submitted further that the loan amount is regularly being paid.

Considering the facts and circumstances of the case, this Court is not inclined to consider the anticipatory bail petition of the petitioner once again.

If the petitioner surrenders and seeks regular bail before the court below, that shall be considered and disposed of on the same day, without being prejudiced by this order. With the aforesaid observation, the application stands disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
