SONI SHRIVASTAVA ORAL ORDER 18-04-2025 Heard learned counsel for the petitioner, learned counsel for the Vigilance Department and the learned counsel for the State.
2. Petitioner apprehends his arrest in connectionw ith Silao P.S.Case No. 169 of 2024 registered for the offences punishable under Sections 420,467,468,471,120B of the Indian Penal Code.
3. The first information report relates to the appointment of the petitioner as a Block Teacher on the basis of forged and fabricated documents.
4. Learned counsel for the petitioner submits that the petitioner was appointed as Prakhand Teacher on 09.02.2014,
Patna High Court CR. MISC. No.72151 of 2024(5) dt.18-04-2025 2/3 thereafter, he joined the said post on 12.02.2014. He further submits that his appointment was done after verification of the documents by the appointing authority at the time of the appointment. However, the petitioner has not made any irregularities in discharging his duty from the date of joining.
5. Learned cousnel for the Vigilance Department opposes the anticipatory bail of the petitioner stating that the allegations amount to serious irregularities. However, it is noted that the petitioner has brought on record, the letter dated 29.10.2024 by way of supplementary affidavit which would go to show that the petitioner has submitted his resignation on 30.10.2024 to the District Program Officer cum Block Education Officer, Silao, Nalanda and hence he is not more in service.
6.Considering all the above mentioned facts and circumstances, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, in the event of his arrest/ surrender within a period of four weeks from today the petitioners shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Nalanda at Biharsharif in Silao P.S.Case No.169 of 2024, subject to condition as laid down under Section 438(2) of the
Patna High Court CR. MISC. No.72151 of 2024(5) dt.18-04-2025 3/3 Cr.P.C and subject to the further condition that the petitioner shall co-operate in investigation/ trial. Further before furnishing the bail bond, the learned court below shall verify the document as annexed as Annexure-6 to the supplementary affidavit to the effect, as to whether the petitioner has resigned from the service or not.
