The petitioners apprehend their arrest in connection with Raghunathpur P.S. Case No. 156 of 2019, registered under Section 30(A) of the Bihar Excise Act.

The accusation is that in course of patrolling duty, two persons were seen on motorcycle with plastic bag. When the signal was given to stop the motorcycle both started to flee away leaving the motorcycle with plastic bag. On search of plastic bag, 50 pouches each containing 500 ml country made liquor recovered. At that time, the persons, who succeeded to flee away, were identified as Bablu Khan (petitioner no.1) and

Learned counsel for the petitioners submits that both petitioners were not apprehended at the spot but their names have surfaced in the F.I.R. mere on suspicion on false information. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Siwan, in connection with Raghunathpur P.S. Case No. 156 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
