JUSTICE BIRENDRA KUMAR ORAL ORDER 11-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411, 467, 468 and 471/34 of the Indian Penal Code.

A stolen motorcycle was recovered by the police. Co-accused Ajaj Sah was driving the said motorcycle and the petitioner was back rider.

Submission is that the petitioner had no knowledge that the motorcycle was a stolen property. The same was of Ajaj Sah. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.28830 of 2018 (2) dt.11-05-2018 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mohania Police Station Case No. 129 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
