Petitioner, already in custody, seeks bail in connection with Sakra PS Case No.497 of 2017, registered under Sections 399/402 of the Indian Penal Code as well as under Sections 25(1-B)A/26/35/25(1-AA)/25(1-AAA) of the Arms Act. Allegation in brief is that on police raid, several miscreants were apprehended and arms were recovered from possession of some of them including this petitioner. It is submitted that the petitioner was apprehended from his home not from the spot as alleged and he is in custody since 23.12.2017 but charge has not been framed. Having considered the aforesaid facts and

No.30856 of 2018(2) dt.17-05-2018 2/2 circumstances, in particular the recovery of arms from the petitioner and from others also, presently the prayer of bail of the petitioner is rejected in connection with Sakra PS Case No.497 of 2017, giving rise to Trial No.1504 of 2018, pending in the court of learned Sub-Judge-XII-cum-ACJM, Muzaffarpur.
