The petitioner is apprehending his arrest in connection with Baheri P.S. Case No.13 of 2018, registered for offences punishable under Sections 420, 275 and 276 of the Indian Penal Code and under section 27 (b)(ii) Drugs & Cosmetic Act, 1940. Allegation against the petitioner is that he is running a kirana shop and from the possession of his shop there was recovery of medicine which he did not produce license and relevant stock register in respect of sale and purchase of medicine. Submission of the learned counsel for the petitioner is that he was not present in the shop and as a mater of fact some other persons has kept medicine in his shop which is general in nature and he has been falsely implicated in this case.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIX, Darbhanga, in connection with Baheri P.S. Case No.13 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure on the condition that the petitioner will co-operate in the investigation. Their failure to appear before the police as well as Court, on two consecutive dates, his bail bond shall be cancelled.
