2. The petitioner apprehends his arrest in connection with Complaint Case No.1518C of 2023 instituted under Section 406 of the Indian Penal Code.

3. As per the complaint case, the allegation against the petitioner is that he had taken signature of informant and his father on a non-judicial stamp paper for the purpose of survey and, thereafter, by frivolous tactics, co-accused Alimuddin Ansari executed a registered deed (Moharnama) of 14 katha land property of the father of the complainant in the name of his wife.

4. Learned counsel for the petitioner submits that

He further submits that there is land dispute between the parties and the dispute is civil in nature. No case is made out against the petitioner who is full brother of co-accused Alimuddin Ansari whose bail has already been granted by learned court below. He further submits that petitioner has no criminal antecedent and he undertakes to co-operate in the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned C.J.M, Bhojpur, Ara / Concerned Trial Court in connection with Complaint Case No.1518C of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
