Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

The FIR of the occurrence of dacoity is against unknown.

Submission is that neither any incriminating material was recovered from possession of the petitioner nor the petitioner was ever put on T.I.Parade during investigation. Petitioner is in custody since 17.05.2017. Other co-accused have already been allowed bail in this case vide Annexures-2,3 and 4.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.29139 of 2018 (2) dt.16-05-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.674 of 2017 (arising out of Jagdishpur Police Station Case No.98 of 2017), subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
