JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30(a) of Bihar Excise Act, 2016. According to prosecution case itself, the alleged recovery has been made from a bamboo clump. Moreover, informant claims to have seen the petitioner and other accused keeping illicit liquor near the said bamboo clump but admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession. Petitioner does not have any criminal antecedent and is languishing in jail custody since 04.09.2019.

Case No. 60 of 2019.
