1. Heard learned counsel for the parties.
2. The petitioner has filed the instant application for grant of regular bail in connection with Amas P.S. Case no. 71 of 2023 registered under sections 406 and 420 of the Indian Penal Code.
3. As per the prosecution case, the informant states that on the pretext of getting them loan to the tune of Rs. 6.62 lakhs from the Punjab National Bank, on being mislead the informant and others gave a sum of Rs.1,99,500/- to the petitioner. After about a year they realised that they had been cheated by the petitioner.
4.Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case. No details have been provided in the FIR with respect to the persons whom the petitioner promised to get loan for. No mode of payment of
Patna High Court CR. MISC. No.71767 of 2023(2) dt.09-11-2023 2/2 the amount alleged has been given and the allegations are mainly one of civil dispute. The petitioner has no criminal antecedent and is in custody since 21.2.2023.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner being in custody since 21.2.2023, not having any criminal antecedent and charge-sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Amas P.S. Case no. 71 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati, Gaya.
