2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 96 of the BNS.
3. The case of the prosecution is that the minor daughter of the informant was missing and the informant came to know that the petitioner has kidnapped her daughter.
4. Learned counsel for the petitioner has submitted that during course of investigation, victim has given her statement under Section 180 and 183 of the BNSS wherein she has specifically stated that she left her house with the petitioner and they went to the house of aunt of the petitioner. Learned counsel has submitted that the statement of the victim itself is
Patna High Court CR. MISC. No.69411 of 2025(2) dt.25-09-2025 2/2 clear to show that the petitioner has committed no offence. Learned counsel has lastly submitted that the petitioner is a man of clean antecedent and is in judicial custody since 10.07.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hulashganj P.S. Case No. 221 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad.
