JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-02-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has filed the instant application for grant of regular bail in connection with Lalganj P.S. Case No. 77 of 2022 registered under sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the accused persons, namely, Ravi Kumar and Sanjay Shukla is to commit murder of son of the informant due to which he succumbed to firearm injury. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is not named in F.I.R. and he has no concern with the alleged occurrence.

No.69812 of 2022(2) dt.28-02-2023 2/2 There is no specific overt act against the petitioner rather the specific allegation of shot fire due to which the informant's son succumbed to injury is against co-accused, namely, Ravi Kumar and Sanjay Shukla and out of them one Ravi Kumar has already been granted bail by the different co-ordinate Bench of this Court vide order dated 23.02.2023. in Cr. Misc. No. 61727 of 2022. The petitioner is languishing in judicial custody since 06.06.2022.
The application for bail is vehemently opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Lalganj P.S. Case No. 77 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali, Hajipur.
