JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kinjar P.S. Case No. 8 of 2015, for the offenses under Sections 147, 148, 149, 341, 504, 435, 436 of the IPC and Section 27 of the Arms Act as well as Section 16 of UAP Act.
Learned counsel for the petitioner admits that there are 12 cases pending against this petitioner. However, he submits that in the instant case similarly circumstanced other co-accused, namely, Bangali Manjhi has been granted by a Coordinate Bench of this Court in Cr. Misc. No. 42811 of 2017 vide order dated 20th of September, 2017.
Considering the fact that similarly circumstanced other co-accused has been granted bail by a Co-ordinate Bench
Patna High Court Cr.Misc. No.30005 of 2018(3) dt.06-06-2018 2/2 this Court, on the ground of parity, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M.,Arwal, Jehanabad in connection with Kinjar P.S. Case No. 8 of 2015 on the condition that one of the bailors shall be the member of the local body and the other bailor shall be family member and further that he will appear in the trial on each and every date failing which the trial court is directed to cancel the bail bonds in case no cogent reasons are available for non-appearance on the date fixed by the trial court.
