JUSTICE NANI TAGIA ORAL ORDER 16-04-2025 This contempt petition has been filed alleging violation of order dated 06.05.2019, passed in C.W.J.C. No. 9819 of 2019, wherein this Court in paragraph no. 4 has passed the following order:- "Considering the nature of claim made by the petitioner, petitioner is directed to file a detailed representation before the Chief Administrator of the Corporation, Respondent No. 3 which will be disposed of within a period of three months from the date of filing of such representation. Any amount due to the petitioner along with admissible interest

Patna High Court MJC No.3943 of 2019(4) dt.16-04-2025 2/3 would be paid within one month thereafter. If certain amounts are inadmissible, the same shall be communicated to the petitioner by passing a speaking order sent through registered post."

Opposite party no.4/ the District Manager, B.S.F.C. has filed a show cause, wherein in paragraph nos. 5, 6, 7 and 8, it has been stated as under:- "5.That the Chief of Administration initiated hearings on the petitioner's representation, involving all concerned parties, and finally disposed of the petitioner's representation on 27.01.2022 with a direction to the District Manager, Khagaria, to consider the petitioner's objections and take necessary actions. The relevant order is contained in Memo No. 992 dated 03.02.2022.

That thereafter, vide letter no. 587 dated 17.04.2023, the District Manager, Khagaria, in consideration of materials available on record, demanded allocation of 21,33,873/- for payment ₹ towards subsistence allowance pertaining to the suspension period and the arrears of salary from 01.08.2006 to 24.01.2007. The Corporation Headquarters sanctioned ₹ 9,82,591/- for payment to the petitioner after adjusting the reported recoverable amount of 11,51,282/- vide Memo ₹ No. 6288 dated 21.08.2023.

That again, the District Manager, Khagaria has demanded allocation of 7,59,950/- ₹ for payment towards post retirement benefits, including gratuity amount, earned leave difference of pay revision etc. In response thereto, the Corporation Headquarters sanctioned the allotment of ₹7,59,950/- for payment towards post retirement benefits and other relevant heads to the petitioner vide Memo No. 8537 dated 22.11.2023.

8. That thereafter, the District Manager,

Patna High Court MJC No.3943 of 2019(4) dt.16-04-2025 3/3 Khagaria has passed necessary orders contained in Memo No. 1235 dated 22.08.2023 and Memo No. 1611 dated 07.12.2023 to effectuate the payment of 9,82,591/- and 7,59,950/- ₹ ₹ respectively to the petitioner."

3. On perusal of the show cause filed, I find that order dated 06.05.2019, passed in C.W.J.C. No. 9819 of 2019 has been complied by the respondents.

4. Accordingly, this contempt petition stands closed and disposed off.
