Petitioner, already in custody, seeks bail in connection with Town (Nagar) P.S. Case No.864 of 2017 registered under Sections 365 and 364/34 of the Indian Penal Code. Allegation in brief is that the petitioner, the rickshaw owner, earlier assaulted the husband of the informant, who was a rickshaw puller and plying the rickshaw of the petitioner alleging that he has got the rickshaw stolen and he is said to have kidnapped the husband of the informant and later on the dead body was found at another place.
Learned counsel for the petitioner submits that the petitioner is a rickshaw owner and there is no motive for killing

No.29597 of 2018(4) dt.17-07-2018 2/2 the husband of the informant, the petitioner has no criminal antecedent, prior to the institution of the present case after finding the dead body of the husband of the informant, another case has been instituted against unknown, the investigation in that case is going on and in the present case charge-sheet has been submitted.
Learned counsel appearing on behalf of the informant opposes the prayer of bail.
Having considered the aforesaid facts and circumstances, petitioner Mithilesh Kumar Singh @ Rana Mithlesh Singh @ Mithilesh Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Town (Nagar) P.S. Case No.864 of 2017.
