The petitioner apprehends his arrest in Dehri(Indrapuri) P.S. Case No.540 of 2017 registered under Sections 307, 353, 332 and other Sections of the Indian Penal Code.
The informant alleged that he got information that many villagers had blocked the road causing inconvenience to the students and other persons. When the police force went there, the accused persons started pelting stones causing injury to the police personnel.
The learned counsel for the petitioner submits that the true facts are that one Kamlesh Singh who is also named in the
Patna High Court Cr.Misc. No.57153 of 2017 (2) dt.02-01-2018 F.I.R. at serial no.11 lodged Dehri P.S. Case No.538 of 2017 alleging therein that the police assaulted his nephew who in order to save his life jumped in the canal and died for that, the villagers made protest and the police lodged this case in order to create defence. It is submitted that no specific allegation is made against the petitioner.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, District-Rohtas at Sasaram in connection with Dehri(Indrapuri) P.S. Case No.540 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
