The petitioners are in custody since 15.02.2018 in connection with Chandan P.S. Case No. 158 of 2017 for the offence registered under Sections 409 and 420 of the Indian Penal Code. Mr. N.K. Agrawal, learned counsel for the petitioners submits that Petitioner no. 1 is the

Chairman and Petitioner no. 2 is the Manager of the PACS, who had purchased 3550 quintals of paddy for supply to the Bihar State Food Corporation and which was to be supplied by 31.07.2017, but the same was not supplied on the Rice Miller and, therefore, the petitioners are alleged to have misappropriated the proportionate amount of money for 1174.50 quintals of C.M.R. It is, however, submitted that the petitioners, being the responsible functionaries, have filed a case against the Rice Miller and necessary steps would be taken in pursuance thereof. It is further submitted that the petitioners may be released on bail and he shall abide by all the terms and conditions as imposed by this Court.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with

Chandan P.S. Case No. 158 of 2017.
