3. Learned counsel for the petitioner has however submitted that there is a fresh encroachment made by the private opposite parties.

4. If the submission of the petitioner is correct, the petitioner shall be at liberty to raise his grievance against the alleged encroacher with the appropriate forum as may be permitted under the law.
