The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 348 of 2013 registered under Sections 394 and 302 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Gaya.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of written report of informant, Javed Khan, Kotwali P.S. Case No. 348 of 2013 was instituted against two unknown. In course of investigation, one Md. Shamshad @ Vikky @ Vajani Miya was apprehended, who confessed his guilt causing injury to deceased in the association of this petitioner, except that there is nothing against the petitioner.

No.29627 of 2018(2) dt.14-05-2018 2/2 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
