The petitioner seeks regular bail in connection with Piparasi P.S. Case No. 22 of 2017, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The allegation is regarding the son of the informant having become traceless and thereafter, a dead body was recovered from the Kitchen garden of the neighbour. The learned counsel for the petitioner submits that there is no allegation whatsoever as against the petitioner herein and merely, on the basis of suspicion, the petitioner has been roped in the present case. It is further submitted

Patna High Court Cr.Misc. No.30949 of 2018(2) dt.23-05-2018 2/2 that the petitioner is having a clean antecedent and he is languishing in custody since 28.06.2017. It is further submitted that the similarly situated co-accused persons have already been granted bail by this Court by an order dated 28.02.2018 passed in Criminal Miscellaneous No. 2515 of 2018 and by an order dated 22.05.2018 passed in Criminal Miscellaneous No. 22040 of 2018.

Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused persons have been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Bagaha (West Champaran) in connection with Piprasi P.S.
