2. The petitioner seeks regular bail in a case registered for the offence punishable under Sections 341 , 323 , 307, 354B, 324, 504, 506 and 34 of the Indian Penal Code . 3 . As per prosecution case , on the alleged date and time of occurrence , this petitioner along with other co-accused person assaulted the son of informant with spade and lathi. Doctor has found the injury grievous in nature .
4. It is submitted by learned counsel appearing on behalf of the petitioner that he has falsely been implicated in this case . The alleged occurrence took place on 04.06.2023 but F.I.R., has been lodged after delay of 10 days for which there is no plausible explanation which itself creates doubt over the entire prosecution case . 5 . Learned A.P.P. for the State vehemently opposed the bail application .
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Bagaha West Champaran in connection with Bagaha P. S. Case No. 420 of 2023 .
