The petitioners seek regular bail in connection with Sanokhar P.S. Case No. 38/2018 for the offences punishable under Sections 188 and 290 of Indian Penal Code and Section 30(A) and 30 (F) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 200 liters Masaledar liquor and 77 bottle of foreign illicit liquor from the Scorpio vehicle.
The learned counsel for the petitioners submits that neither the petitioners are owner nor driver of the said vehicle, hence, recovery of said liquor is not attributed to the petitioners. It
Patna High Court Cr.Misc. No.31805 of 2018 (2) dt.31-05-2018 2/2 is further submitted the petitioners have a clean antecedent and languishing in custody since 02.04.2018.
Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge Excise, Bhagalpur in connection with Sanokhar P.S. Case No. 38/2018.
